At a recent meeting of the Standards Review and Interpretation Committee (SRIC) the committee directed staff to post for client comments the following proposed standard revision and a standard deletion. Please post your comments prior to Friday May 14th, 2021.
61.1.2 (LE1) (M M M M) (LE1) Uniform Enforcement Procedures
A written directive establishes uniform procedures for taking enforcement action incidental to traffic law violations, to include:
a. physical arrest;
b. citation or notice to appear; and
c. warnings; and
d. special processing requirements, if any.
Commentary
The directive should establish guidelines to ensure that enforcement actions are commensurate with applicable laws and take into account the degree and severity of the violation committed. Special processing requirements may be required for juveniles, military personnel, diplomats/consular officials or legislators. Warnings, written or verbal, or other non-punitive enforcement actions should be substituted for arrests or citations when appropriate, especially in the case of inadvertent violations. Agencies should prohibit practices requiring officers to issue a predetermined number of citations, arrests, or summonses, or to initiate investigative contacts with citizens for reasons not directly related to improving public safety. 61.1.3 (LE1)
(M M M M) (LE1) Violator Procedures
A written directive establishes procedures for handling traffic law violations committed by:
a-. nonresidents of the agency's service area;
ba. juveniles;
c. legislators;
db. foreign diplomats/consular officials; and
e. military personnel.
Commentary
The written directive should address all special processing requirements, if any, for juveniles or foreign diplomats
immunity, or procedures that apply to traffic law violations committed by these two groups
